AB 927 - Extends Requirements for Design and Construction Defect Actions

Assembly Bill 927 (hereinafter “AB 927”) amends Civil Code Section 1375 (sometimes referred to as the “Calderon Process”), by extending its operative date to July 1, 2017. The “Calderon Process” describes the special pre-litigation procedures applicable to construction defect disputes in common interest developments. These procedures require an association to complete certain actions, such as filing a notice regarding commencement of legal proceedings and participating in a dispute resolution process, before a lawsuit for construction defects can be filed. AB 927 essentially maintains the status quo for filing construction defects lawsuits in common interests developments.
